Terms of use

The General Terms and Conditions contain all mutual obligations between the 'User', the 'Member', and Construction Hub regarding the use of the Construction Hub Platform.

Construction Hub provides services related to the recruitment process by providing Users and Members with a job application platform to apply for job offers published on it.

1. DEFINITION

1.1. For the purposes of these General Terms and Conditions, the following terms have the following meanings:

‘Personal Data’ refers to Article 4(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), and means “any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”;

‘Computer Support’ means the various media that can be used to access the Construction Hub Platform. This includes smartphones, tablets, PCs, or Apple computers with an internet connection and any object that is connected or can be connected to another object and to the internet;

‘User’ refers to any person browsing the Construction Hub Platform through any computer medium (e.g., a visitor). This also refers to the User who participates in the account creation process and whose Account has not yet been verified and accepted by Construction Hub;

‘Member’ refers to any person who has an ‘Account’ that allows them to apply for the job offers published. Their Account has been previously verified and accepted by Construction Hub as part of the account creation process, as described in Article 4 of the General Terms and Conditions;

‘Employer’ means any natural or legal person participating in the recruitment process relating to the published job offers and to whom the employment decision belongs solely.

2. SCOPE

2.1. These General Terms and Conditions apply to any visit to or use of the Construction Hub Platform and are intended to establish the terms and conditions for accessing, providing, and using the Platform, as well as its features and content, by Users and Members.

2.2. Users and Members acknowledge that by visiting or using the Construction Hub Platform, they are aware of these General Terms and Conditions and expressly agree to the rights and obligations arising therefrom.

2.3. Construction Hub reserves the right to amend or update these General Terms and Conditions at any time without prior notice. However, we will apply the General Terms and Conditions in force at the time of use or visit to the Construction Hub Platform.

2.4. The Dutch version of the General Terms and Conditions is determinative for their interpretation.

3. PERSONAL DATA

3.1. Construction Hub collects Personal Data about Users and Members during their visit to or use of the Construction Hub Platform in accordance with the Privacy Policy available via the following link: https://www.construction-hub.be/nl/page/privacyverklaring.

3.2. This personal data is collected, processed, stored, and kept in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, applicable since 25 May 2018. Data processing is also in accordance with the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

4. SERVICES OF CONSTRUCTION HUB

4.1. Applying for jobs

Construction Hub offers, among its services, the possibility to apply for both anonymous and non-anonymous job offers (where anonymous job offers correspond to offers where the name of the Employer is not mentioned in the job offer description) for the Members of its Platform. These job offers are regularly updated and contain information about the profile sought and the position to be filled by the Employer.

4.2. Job Notification – Newsletter – News

4.2.1. Users and Members have the possibility to receive periodic email notifications of new job offers published on the Construction Hub Platform by subscribing to the Job Notification from Construction Hub.

4.2.2. In this case, they agree to receive regular notifications of new job offers published on the Platform. Users and Members also have the option to stay informed about the latest news and trends in the construction sector. For this purpose, they can subscribe by email to the Newsletter from Construction Hub, which provides information about news, trends, and events in the construction sector.

5. ACCOUNT CREATION

5.1. To use the services of Construction Hub, the User must first create an Account on the Construction Hub Platform.

5.2. Creating an Account is free and can be done at any time by the User, provided that they accept the conditions of Construction Hub as set out in these General Terms and Conditions and the applicable legislation on the protection of Personal Data.

5.3. When creating an Account, the following Personal Data is required to be collected: first name, last name, email address, password, and phone number. This data is used by Construction Hub to identify the User and ensure the proper functioning of their Account.

5.4. The User is solely responsible for the confidentiality of their password and is solely responsible for all activities that occur under their Account.

5.5. The User agrees to immediately notify Construction Hub of any unauthorized use of their Account or any other security breach.

6. RESPONSIBILITIES OF CONSTRUCTION HUB

6.1. Construction Hub undertakes to regularly update and maintain the published job offers on the Construction Hub Platform.

6.2. Construction Hub undertakes to protect and secure the Personal Data of Users and Members in accordance with the Privacy Policy.

6.3. Construction Hub undertakes to take all reasonable measures to ensure the availability, security, and proper functioning of the Construction Hub Platform.

7. RESPONSIBILITIES OF THE USER AND THE MEMBER

7.1. The User and the Member undertake to use the Construction Hub Platform in accordance with the applicable legislation, these General Terms and Conditions, and the Privacy Policy.

7.2. The User and the Member undertake to respect the Personal Data of other Users and Members and not to collect or use Personal Data without the express consent of the individuals concerned.

7.3. The User and the Member undertake not to disrupt the proper functioning of the Construction Hub Platform by introducing viruses, Trojan horses, worms, logic bombs, or other harmful or technologically damaging materials. They must also not attempt to gain unauthorized access to the Construction Hub Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. The User acknowledges and accepts that all intellectual property rights relating to the Construction Hub Platform and its content (including, but not limited to, text, images, videos, audio, logos, trademarks, software, databases, designs, graphic elements, etc.) are owned by Construction Hub or its licensors.

8.2. The User undertakes to respect these intellectual property rights and may use the content of the Construction Hub Platform solely for personal and non-commercial purposes. Any other reproduction, distribution, transmission, or exploitation of the content of the Construction Hub Platform is strictly prohibited without the prior written consent of Construction Hub.

9. LIABILITY

9.1. Construction Hub shall not be liable for any damages arising from the use of the Construction Hub Platform, including, but not limited to, direct, indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, loss of revenue, loss of business opportunities, business interruptions, loss of goodwill, or any other intangible loss.

9.2. Construction Hub shall not be liable for any damages caused by the unauthorized use of Personal Data by third parties.

9.3. The User and the Member acknowledge that the use of the Construction Hub Platform is at their own risk and that Construction Hub shall not be liable for any damages caused by the use of the Platform.

10. APPLICABLE LAW AND JURISDICTION

10.1. These General Terms and Conditions shall be governed by and construed in accordance with Belgian law.

10.2. Any disputes relating to the validity, interpretation, performance, or termination of these General Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the judicial district of Brussels.
